Terms of Service — Held & Seen

Please read these Terms of Service ("Terms") carefully before using Held & Seen (the "App"), created by Via Lumen / Mountain Spring Farm.By creating an account or subscribing, you agree to be bound by these Terms.
1. Description of the Service
Held & Seen is a contemplative reflection tool combining guided prompts, journaling, and an AI companion called "the Lantern," which uses the Anthropic Claude API to respond to your written reflections in a spiritual-direction voice, informed by the Held & Seen "Lantern Charter."
The App is offered as a paid monthly subscription. Free/trial terms, if offered, will be stated at sign-up.
2. Eligibility
You must be at least 18 years old to create an account. By using the App, you represent that you meet this requirement.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at [email] if you suspect unauthorized use.
4. Subscription & Payment
Subscriptions are billed monthly at the rate shown at sign-up.
Subscriptions renew automatically each month unless canceled before the renewal date.
You may cancel at any time through by emailing us; cancellation takes effect at the end of the current billing period. We do not provide partial-month refunds unless required by law.
We reserve the right to change subscription pricing with at least [30] days' notice to active subscribers.
5. The Lantern Is Not a Substitute for Professional Care
This is important, please read it carefully.
The Lantern is an AI feature, not a human being, licensed therapist, counselor, spiritual director, or member of clergy. Its responses are generated by an AI model and are intended for reflective, contemplative use only.
The Lantern does not diagnose, treat, or provide medical, psychiatric, psychological, or professional spiritual/pastoral advice.
Nothing generated by the Lantern should be relied upon as a substitute for care from a licensed professional.
If you are experiencing a mental health crisis, thoughts of self-harm, or any emergency, stop using the App and contact 988 (Suicide & Crisis Lifeline), 911, or another emergency service immediately.
Via Lumen / Mountain Spring Farm or any of its agents or founds is not liable for decisions made based on Lantern responses.
6. Acceptable Use
You agree not to:
Use the App for any unlawful purpose
Attempt to access another user's account or reflections
Attempt to reverse-engineer, scrape, or misuse the underlying AI system
Use the App to generate or submit harmful, abusive, or illegal content
We reserve the right to suspend or terminate accounts that violate these Terms.
7. Your Content
You retain ownership of the reflections and journal content you write. By using the App, you grant us a limited license to store and process that content solely to provide the service to you (including sending it to the Anthropic API to generate Lantern responses, as described in our Privacy Policy).
We do not claim ownership of your reflections.
8. Intellectual Property
The Held & Seen name, design, the Lantern Charter, and associated content are the property of Via Lumen / Mountain Spring Farm. You may not copy, reproduce, or redistribute the App's content or branding without permission.
9. Disclaimers
The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee the App will be uninterrupted, error-free, or available at all times. AI-generated responses may occasionally be inaccurate, incomplete, or not reflect your intended meaning.
10. Limitation of Liability
To the fullest extent permitted by law, Via Lumen / Mountain Spring Farm, LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including reliance on Lantern-generated content.
11. Termination
You may stop using the App and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or misuse the service.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
